Access Cass County Court Records

Start with the right office when you need Cass County court records. Every court here keeps its own file, so your first job is figuring out which one holds the paper you want. Docket entries, filed papers, orders, judgments, and certified clerk copies all live with the clerk of that particular court. Before you call or visit, know the record type and whether a plain copy will do or the document must be certified. An online index can point you to an item. It cannot prove authenticity or show a whole case. Go to the clerk directly when an image is missing, the file is old, or access is limited. Texas state court rules, not a routine agency request, govern access to judicial and case records.

Getting Cass County Court Records

Pick the custodian before anything else. That choice decides where your request goes. District Clerk Jamie Albertson handles district civil, criminal, family, and juvenile filings, plus the County Court at Law categories the OCA lists. For probate and county court case material, start with County Clerk Amy L. Varnell. JP and municipal records stay with the precinct or city court that heard the matter.

  1. Gather the exact court name, cause or citation number, document title, and approximate filing date.
  2. Use Aumentum Recorder Public Access for indexed County Clerk material and available convenience images.
  3. For eligible statewide electronic records, register for re:SearchTX and check its Cases or Filings views.
  4. Call the District Clerk at (903) 756-7514 or the County Clerk at (903) 756-5071 to confirm custody, copy type, current cost, and delivery method.
  5. Visit the District Clerk at 604 Highway 8 North or the County Clerk at 100 East Houston Street in Linden. County Clerk materials identify public-terminal searching for criminal and probate records.
  6. Mail a focused request to the District Clerk at P.O. Box 510 or County Clerk at P.O. Box 449, Linden, Texas 75563, after confirming payment and return arrangements.
  7. Use the county records-request page for the proper administrative department, but route court case records to the clerk or judge under applicable judicial-record law.

Cass Custodian Decision

One office can hold a docket sheet and the papers behind it, even if different public tools display them. The court calendar shows settings only. Aumentum is an indexed clerk-record system. Per its 2026 job description, the District Clerk's office answers public questions about civil and criminal cases, filing fees, jury service, and child support.

Court Record Types

Name a specific document when you request a Cass County record. Asking for "the whole case" invites delay, a large copy job, and confusion over protected material. Give the clerk the cause number and document title so the right file comes up fast.

  • Docket sheets or event histories showing filed and scheduled activity.
  • Pleadings, motions, notices, and other filed documents available under governing access rules.
  • Signed orders, judgments, and disposition records.
  • Probate applications, orders, inventories, or other estate-file documents when publicly available.
  • Plain reproductions for reading and certified copies for an official use.
  • Appellate records or federal docket documents held by the separate appellate or federal court.

Transcripts take extra care. Cass County offers no single general transcript-order portal, so ask the clerk or court coordinator whether a court reporter holds the material and what request process applies.

Aumentum Copy Workflow

The County Clerk's official instructions split searching from buying. A user searches the index, opens an available image, and picks pages. The pages go into a basket for review. Payment is by card, and the purchase is then retrieved. The landing page carries session controls for public or private computers. It may also offer date shortcuts. An online printout is still not a certified record. Images can go dark during backup periods. An index may describe an item without holding every court filing. For current process, contact, and certification details, the County Clerk page is the authority. When a certified document is required, ask the office.

Inside a Cass County Court Record

What is inside depends on the case and the document. A docket entry records a short event; a filing or order carries the underlying text. The clerk can explain which items exist but will not create a new report.

Cause numberThe court identifier used to locate and distinguish the case.
Case styleThe official caption; avoid unnecessary reuse of private names.
Court and case typeThe tribunal and category that determine custody and access.
Filed dateThe date an item entered the file, not necessarily the hearing date.
Docket eventA filing, setting, continuance, order, or other recorded action.
Document imageThe filed paper when electronic viewing is allowed and available.
Disposition or judgmentThe official outcome entry or signed order, which should be verified with the clerk.
CertificationThe clerk’s attestation on a copy produced by the custodian.

Filed, charged, set, continued, dismissed, deferred, and convicted are not synonyms. When the outcome matters, read the signed order alongside the current docket.

Cass Older Probate Search

Probate is a clerk function, and Cass County has accepted probate e-filings since January 1, 2015. Attorney e-filing became mandatory January 1, 2016. Those dates explain modern electronic access, but the older index still stands.

Older probate needs a different route. The posted fee material says probate before 2005 requires office index research.

For an estate file, bring the decedent or estate name, the cause number if known, the approximate filing year, the document you want, and your plain-or-certified choice. Use the County Clerk counter or the public terminal, and ask staff about the office index. If an Aumentum image is missing, that does not mean the probate record does not exist.

Fees and Certified Copies

The county-hosted County Clerk schedule posts these charges and rules. Posted schedules change, so confirm the total before sending money. The District Clerk's linked spreadsheet is dated 2022 and is not a current universal Cass fee list.

County Clerk servicePosted amount or rule
Plain OPR, probate, or criminal copy$1 per page
Certified copy$1 per page plus $5 certification per document
Certification authorityOnly copies made by the County Clerk can be certified by that office
Phone requestNo phone copy requests stated
Fax deliveryNo fax copies stated
PaymentCash, money order or cashier’s check, and debit or credit card; no personal checks

A phone call works well for confirming custody, price, page count, and mailing steps. It is no shortcut around the posted no-phone-copy rule. Online Aumentum purchases run on a credit-card workflow.

Cass Written Request Routing

The Cass judicial and open-records page carries a warning. Judicial records do not follow the ordinary Texas Public Information Act process. Government Code Chapter 552, including section 552.0035, sends judiciary access questions to Supreme Court rules and other applicable law. Send administrative county requests to the department holding them. Case-record requests start with the court clerk or judge instead. Texas Rule of Judicial Administration 12 governs judicial records within its scope. It requires a written request with enough detail. OCA policy separates administrative judicial records from case records kept by clerks under statutes, rules, and common law. A focused request names an existing document. Do not ask the office to create a report or legal conclusion.

Sealed Records and Public Access

Public access has limits. Rule 76a starts from openness for covered civil court records but allows sealing only under its serious-interest, balancing, and least-restrictive-means test. Records made confidential by another law stay closed. Family Code Chapter 58 puts juvenile records under special access rules, and Code of Criminal Procedure Chapter 55A supplies the current expunction framework.

A missing record has several possible causes. Restriction, sealing, expunction, limited portal coverage, an older index, or the wrong custodian can all produce no online result.

Let the clerk determine whether a record can be inspected, redacted, or released to the requester.

Chapter 45A also covers confidentiality and procedure in justice and municipal matters. A payment receipt or fine listing is not a certified disposition. Get the court record from the court that heard the citation.

Cass Record Verification

Before you trust any copy of a Cass County court record, check the basics. Match the cause number, the court, the filed date, and the document title. Ask the clerk whether your copy is plain or certified. Confirm every page is there. Ask, too, whether a newer signed order has changed the docket entry. Posted dockets can shift without notice. Confirm any hearing date before you act. The Cass County court dates page covers the schedule questions.

Where the file lives depends on the case. An appeal's record sits with the Sixth Court of Appeals in Texarkana. The trial file stays with the Cass clerk. Federal civil and criminal filings go through PACER or CM/ECF. That route covers the Eastern District of Texas, Marshall Division. CourtListener or RECAP can aid discovery, but the official clerk or docket remains the source that verifies.
